Court Sides With Paris Hilton In Hallmark Fight


an appeals court has ruled that Paris Hilton can continue pursuing a lawsuit against Hallmark Cards Inc. over the use of her picture and catch phrase “That’s hot” on a greeting card.

Hilton sued the company in 2007 after it began selling without her permission birthday cards of a cartoon of a waitress serving a plate of food to a patron. A photo of Hilton’s face was pasted on the cartoon’s body.

Hilton alleges that the card ripped off her appearance as a waitress in an episode of her reality television show “The Simple Life.”

The 9th U.S. District Court of Appeals on Monday upheld a lower court’s ruling allowing the bulk of Hilton’s lawsuit. Hallmark has defended the card as parody, which is normally protected under fair-use law.

Chris Brown Issues Statement Over CNN Interview: ‘Of Course I Remember What Happened’




Chris Brown has issued a statement explaining that an advance clip of his interview with Larry King, set to air on Wednesday night on CNN, has been taken out of context, and, in fact, he does remember the incident with Rihanna that led to him pleading guilty to assault.

On Monday, CNN released clips, which show the “Larry King Live” host asking Brown, “Do you remember doing it?” referring to the beating of his then-girlfriend Rihanna in the early hours of February 8. Brown is heard in the clip replying, “No.”

But in a statement issued to People on Monday, the singer said during the interview with King, which was attended by his attorney, Mark Geragos, and his mother, Joyce Hawkins, “That question was asked something like four or five times.”

“When you look at the entire interview you will see it is not representative of what I said,” Brown said in his statement to the mag regarding his “no” answer.

“The first four times – or how ever many times it was – I gave the same answer – which was that I didn’t think it was appropriate for me to talk about what happened that night. I said it was not right for me and it really wasn’t fair to Rihanna. The fifth time – or whatever it was – I just misspoke. I was asked, ‘Do you remember doing it?’ and I said, ‘No,’” Brown’s statement continued.

Brown added that he does indeed remember the incident that sent Rihanna to the hospital; however, he also referred to it as “a blur.”

“Of course, I remember what happened. Several times during the interview, my mother said that I came to her right afterwards and told her everything. But it was and still is a blur,” his statement continued. “And yes, I still can’t believe it happened because it is not me or who I am.”

Brown added that he continues to live with remorse over the incident.

“As I have said several times previously, I am ashamed of and sorry for what happened that night and I wish I could relive that moment and change things, but I can’t. I take full responsibility for my actions,” his statement concluded. “ What I have to do now is to prove to the world that this was an isolated incident and that is not who I am and I intend to do so by my behavior now and in the future.”

Chris Brown Sentenced For Rihanna Assault


The judge placed Brown on felony probation for 60 months (5 years). Brown is required to report for probation within 72 hours. Brown will perform his community labor in Virginia, where his permanent residence is.

He must also complete a 52-week domestic violence program – sponsored by the Commonwealth Catholic Charities – and perform 180 days of community labor, for which he will perform trash pickup, wash cars and cleaning and maintain grounds.

Brown was fined $2,500 in restitution, a $2,500 probation fine a $30 court security fee, a $30 criminal conviction fee and a $400 domestic violence fee.

The judge ordered a protective order, keeping Brown away from Robyn Fenty (Rihanna). He will be required to submit DNA samples if requested by law authorities. He will be also be required appear before the judge in court every three months. His next appearance will be on November 19.

Brown’s probation will conclude on August 25, 2014.

A Los Angeles Superior Court Judge is expected to sentence Chris Brown today over his assault of Rihanna.

The singer is scheduled to appear in court today at 2 PM, where the final sentencing will be handed down related to charges stemming from a February 8 incident where he assaulted his then-girlfriend, Rihanna. The hearing was initially scheduled for August 27, but lawyers for Brown requested that it be held today.

As previously reported on AccessHollywood.com, Brown struck a plea deal with prosecutors. Under the deal, the singer pleaded guilty to one felony assault charge. His plea deal included five years of probation, enrollment in a domestic violence counseling program and 180 days in a labor program in his home state of Virginia.

During Brown’s last court appearance on August 5, Judge Patricia M. Schnegg stressed that she did not want the labor program to be community service, but actual labor. The parties agreed that they needed more time to figure out the labor portion of the plea deal and, as a result, sentencing was postponed until today.

In July, the 20-year-old finally spoke out for the first time about the incident with Rihanna, apologizing for his actions.

“Since February, my attorney has advised me not to speak out, even though ever since the incident I wanted to publicly express my deepest regret and accept full responsibility,” the singer said in a two-minute clip posted on his official YouTube channel. “Although I will do some interviews and answer some questions in the future, I felt that it was time that you heard directly from me that I am sorry.”

Brown appears to have also addressed the events of February 8 in his new song, “Changed Man.”

The superstar will be honored by the industry publication at its annual Women in Music event.

Past “Woman of the Year” honorees were Ciara and Reba McEntire.

Beyonce will be on hand to accept her award at the Oct. 2 event in New York City.

It’s been yet another big year for the entertainer. She had the smash hit “Single Ladies,” sang at President Obama’s inauguration, had a No. 1 movie with “Obsessed” and embarked on an arena tour.

Police Seek Missing Car In Murder Of Ex-Model


Police who sought a reality show contestant in the Southern California slaying of his ex-wife have still not located the crime scene and believe the victim’s missing white Mercedes-Benz could be the key.

Buena Park police Sgt. William Kohanek said Monday the car is part of a “big unsolved puzzle” as they try to determine where ex-model Jasmine Fiore was killed.

Fiore’s body was found Aug. 15 in a trash bin. Her fingers and teeth were missing.

Orange County prosecutors charged her ex-husband, Ryan Jenkins, with murder and launched an international manhunt.

Jenkins, who appeared on VH-1’s “Megan Wants a Millionaire,” was found dead Sunday in a motel room in his native Canada.

The missing car is a white 2007 Mercedes-Benz CL S550 with a black top and black rims.

Coroner Rules Michael Jackson’s Death A Homicide


The Los Angeles County coroner has ruled Michael Jackson’s death a homicide and a combination of drugs was the cause, a law enforcement official told The Associated Press, a finding that makes it more likely criminal charges will be filed against the doctor who was with the pop star when he died.

Forensic tests found the powerful anesthetic propofol acted together with at least two sedatives to cause Jackson’s death June 25 in his rented Los Angeles mansion, according to the official, who spoke on condition of anonymity because the findings have not been publicly released.

Dr. Conrad Murray, a Las Vegas cardiologist who became Jackson’s personal physician weeks before his death, is the target of a manslaughter investigation by the Los Angeles Police Department. A designation of homicide means that Jackson died at the hands of another, but does not necessarily mean a crime was committed.

A search warrant affidavit unsealed Monday in Houston includes a detailed account of what Murray told investigators.

According to the document, Murray said he’d been treating Jackson for insomnia for about six weeks with 50 milligrams of propofol every night via an intravenous drip. But he said he feared Jackson was forming an addiction to the anesthetic, which is normally used in hospitals only, and was attempting to wean his patient by lowering the dose to 25 milligrams and adding the sedatives lorazepam and midazolam.

That combination succeeded in helping Jackson sleep two days prior to his death, so the next day, Murray told detectives he cut off the propofol — and Jackson fell asleep with just the two sedatives.

Then around 1:30 a.m. on June 25, starting with a 10-milligram tab of Valium, Murray said he tried a series of drugs instead of propofol to make Jackson sleep. The injections included two milligrams of lorazepam around 2 a.m., two milligrams of midazolam around 3 a.m., and repeats of each at 5 a.m. and 7:30 a.m. respectively.

But they didn’t work.

Murray told detectives that around 10:40 a.m. he gave in to Jackson’s “repeated demands/requests” for propofol, which the singer referred to as his “milk.” He administered 25 milligrams of the white-colored liquid, — a relatively small dose — and finally, Jackson fell asleep.

Murray remained with the sedated Jackson for about 10 minutes, then left for the bathroom. No more than two minutes later, he returned — and found Jackson had stopped breathing.

“There’s no surprise there” that death could result from such a combination, said Dr. David Zvara, anesthesia chairman at the University of North Carolina at Chapel Hill.

“All those drugs act in synergy with each other,” Zvara said. Adding propofol on top of all the other sedatives “tipped the balance.”

Besides the propofol and two sedatives, the coroner’s toxicology report found other substances in Jackson’s system but they were not believed to have been a factor in the singer’s death, the official told the AP.

When he died, Jackson was skinny but not overly emaciated, and his body had bed sores, the official said. The singer is believed to have developed bed sores in the months following his 2005 acquittal of child molestation charges, when he went into seclusion and spent long stretches in bed.

Murray has spoken to police and last week released a video saying he “told the truth and I have faith the truth will prevail.” Murray did not say anything about the drugs he gave to Jackson. Murray’s attorney, Edward Chernoff, had no immediate comment but has previously said Murray never administered anything that “should have” killed Jackson.

A call to the coroner’s office was not returned Monday.

Jackson’s family released a statement Monday, saying it has “full confidence” in the legal process and the efforts of investigators. It concludes: “The family looks forward to the day that justice can be served.”

The 25 milligrams of propofol Murray told police he gave Jackson the day he died “is not a whopping amount,” said Lee Cantrell, director of the San Diego division of the California Poison Control System. But by combining propofol with a cocktail of the other sedatives, known as benzodiazepines, it “may have been the trigger that pushed him over the edge,” Cantrell said.

Cantrell said it’s perplexing that someone would give various benzodiazepines if one was found not to be effective.

“This is horrible polypharmacy,” he said, referring to the interaction between the various drugs. “No one will treat an insomniac like this.”

The affidavit says Murray told investigators he didn’t order or buy any propofol and had found about eight bottles of it in Jackson’s home along with numerous other medications. But investigators served a search warrant Aug. 11 at a Las Vegas pharmacy and uncovered evidence showing Murray legally purchased from the store the propofol he gave Jackson the day he died.

Murray didn’t tell paramedics or doctors at UCLA hospital where Jackson was rushed June 25 about any drugs he administered other than lorazepam and flumazenil, according to the affidavit. The document says it was only during a subsequent interview with Los Angeles Police detectives that Murray gave a more full accounting of the events leading up to the 911 call.

The coroner’s office has not publicly released its autopsy findings, citing a request from police detectives to withhold results until their investigation is complete.

Homicide, or “death at the hands of another,” is one of several possible findings in a coroner’s death investigation. The designation does not necessarily mean a crime was committed though it is a useful starting point for prosecutors, said Dr. Michael Baden, the former chief medical examiner in New York City and a forensics expert involved in many high-profile murder cases.

“It is an easier prosecution when the medical examiner calls it a homicide,” said Baden, who is not involved in the Jackson investigation.

Additionally, in the search warrant, obtained by Access Hollywood, Murray reportedly told officials that he estimated Jackson was not breathing at 11 AM. According to the physicians cell phone records obtained by authorities, Murray made three calls between 1118 and 1205, which authorities claim he did not tell them about during interviews.

The warrant also revealed that a prescription pill bottle of Tizanidine (zanaflex), prescribed to Jackson by Dr. Arnold Klein, was found at the pop star’s bedside.

According to the warrant, an unidentified female caller spoke to authorities and claimed Jackson used a host of aliases including Omar Arnold, Fernand Diaz, Peter Madonie and Josephine Baker as aliases when he visited Dr. Klein.

Additionally, detectives recovered a prescription at Jackson’s home prescribed by Klein and in the name of Omar Arnold.

Although authorities subpoenaed medical records from Klein, he only provided records dating back to March 2009, according to the warrant.

On Monday evening, an attorney for Murray issued a statement about the report.

“Much of what was in the search warrant affidavit is factual. However, unfortunately, much is police theory,” the statement read. “Most egregiously, the timeline reported by law enforcement was not obtained through interviews with Dr. Murray, as was implied by the affidavit. Dr. Murray simply never told investigators that he found Michael Jackson at 11:00 am not breathing. He also never said that he waited a mere ten minutes before leaving to make several phone calls. In fact, Dr. Murray never said that he left Michael Jackson’s room to make phone calls at all.

“We will not comment on the ‘anonymous’ law enforcement source that claims that Michael Jackson’s death will be ruled a homicide. Most of the reports by ‘anonymous’ sources have been proven wrong,” the statement continued. “We will be happy to address the Coroner’s report when it is officially released.”

Billy Ray Cyrus has spoken out for the first time about daughter Miley Cyrus’ provocative performance that included the teen singer dancing around a pole at the Teen Choice Awards earlier this month.

At the August 10 event, while singing her hit song, “Party In The USA,” Billy Ray’s 16-year-old daughter jumped on top of an ice cream cart, pushed by her back up dancers. While performing the song, Miley crouched and danced next to a metal pole attached to the top of the cart, which attracted a host of criticisms across the Web.

When asked about headlines that suggested the teen got a little ahead of her age by dancing with the metal pole, Billy Ray — who Access Hollywood caught up with at the Hellmans/Facebook Feeding America Event in NYC on Thursday — said Miley remains focused on “entertaining.”

“You know what? I just think that Miley loves entertaining people,” Billy Ray told Access. “She loves singing [and] songwriting.”

And while some might have taken exception to Miley’s performance, her father encouraged her to block out the negative comments.

“I always tell her to love what you’re doing and stay focused for the love of the art and not worry so much about opinion,” he added.

Jackson ‘This Is It’ Film Gets 2-Week Limited Run


A Michael Jackson film built around rehearsal footage left behind after his death will be released in a limited two-week theatrical engagement worldwide.

Distributor Sony announced Thursday that the release date for “Michael Jackson: This Is It” has been moved up to Oct. 28, two days earlier than previously announced. Tickets go on sale Sept. 27.

The studio also announced longtime Jackson collaborator Kenny Ortega is directing “This Is It,” which offers a behind-the-scenes glimpse of Jackson preparing for a series of London shows he was rehearsing when he died June 25.

Ortega had been working with Jackson on the “This Is It” concert tour, which had been planned as a colossal 50-show engagement at London’s O2 Arena. His other credits include the “High School Musical” movies and an upcoming remake of “Footloose.”

“This film is Michael’s gift to his fans,” Ortega said. “It’s a very private, exclusive look into a creative genius’s world. For the first time ever, fans will see Michael as they have never seen him before — this great artist at work. It is raw, emotional, moving and powerful footage that captures his interactions with the ‘This Is It’ collaborators that he had personally assembled for this once in a lifetime project.”

Sony paid $60 million for rights to the film, which will be drawn from more than 100 hours of footage shot in Los Angeles between April and June as Jackson prepared for the concerts that were to begin in July.

The filmmakers initially intended to include some 3-D footage but have dropped that plan. The film will show Jackson working with singers, dancers, musicians, choreographers and special-effects experts, Ortega said.

Oprah Launching New Season With Whitney Houston Interview


When “The Oprah Winfrey Show” returns for its 24th season, Oprah will have a very special guest on her couch.

Whitney Houston will be the TV mogul’s first guest of the season in the diva’s first sit-down interview in nearly seven years, a chat that Oprah calls “the most anticipated music interview of the decade.”

The Sept. 14 interview will come two weeks after the release of the Whitney’s highly anticipated comeback album, “I Look To You,” slated for Aug. 31.

Paula Abdul’s Manager There Have Been ‘No Discussions Whatsoever About’ ‘American Idol


Paula Abdul is not in talks to return to “American Idol,” her manager, David Sonenberg, told the Los Angeles Times.

There are “no discussions whatsoever about ‘Idol,’ " he told the paper.

Earlier this month, Abdul ended her negotiations to renew her contract with the FOX reality series via her Twitter account.

“With sadness in my heart, I’ve decided not to return to #Idol,” she posted on her Twitter page on August 4.

And while Abdul’s manager said “never count anything out,” when asked about the judge’s possible return, it seems she is moving on.

“She feels fabulous. She feels free,” Sonenberg told the newspaper. “I think in some ways she was typecast in ‘Idol’ and she was kind of restricted from doing anything she wanted to do and now she’s free to decide. She really is very excited about the future and that there’s support for her.”

Sonenberg confirmed that Abdul had spoken with people at most of the networks – apart from FOX — and she has a host of opportunities in front of her.

“She loves television. She has a number of exciting ideas, some of which are competitive, some of which are just theme-oriented,” Sonenberg said. “I think you’re going to be seeing a lot of Paula, sometimes as an executive producer, sometimes as a performer or mentor and sometimes as a creative developer.”

As for Abdul’s future, she herself suggested her path may not lie where people expect in a new Twitter post on Wednesday evening.

“People take different roads seeking fulfillment and happiness. Just because they’re not on your road doesn’t mean they’ve gotten lost,” she wrote.

Joe Jonas Signs On For ‘Idol’ Judge Slot; Kelly Clarkson Approached


A rep for the Jonas Brothers confirmed that the raven-haired singer has signed on to judge alongside Simon Cowell, Randy Jackson and Kara DioGuardi, People reported.

Joe will judge in Dallas, TX, on Monday August 24.

Previously, a FOX executive told reporters that “Idol” was looking for a host of women to fill the slot vacated by Paula Abdul, who decided not to return to the “Idol” judges’ table. Joe will be the first male guest judge this season.

Former Spice Girl Victoria Beckham recently filled in on two separate stops on the “American Idol” auditions cross-country jaunt.

Katy Perry, Mary J. Blige and Shania Twain have also been confirmed as upcoming guests.

And in related news, according to the Los Angeles Times, Kelly Clarkson, the original “American Idol” winner is in talks to also take a seat on the panel to help whittle down the batch of contestants.

Reps for Joe and Kelly were not immediately available for comment.

Britney Spears Dons A Bikini To Read ‘Top Ten’ List On ‘Letterman’


A bikini-clad Britney Spears hit the set of the “Late Show with David Letterman” on Tuesday, where she presented one of the show’s famous “Top Ten” lists.

The theme of the pop princess’ list was the “Top Ten Ways The Country Would Be Different If Britney Spears Was President.”

Wearing the dark-colored two-piece, and perched on a stool with a red flower in her hair, Britney shared her views.

“I’d be the first president to wear eye shadow since Nixon,” the pop singer said as her No. 10 answer, to hearty laughs from the “Letterman” audience.

Britney said her No. 9 way the country would be different was, “We would only invade fun places like Cabo.”

And in the final clip made available by CBS in advance of the episode airing, Britney offered her No. 8 way the country would be different if she was Commander in Chief.

“Free Pie for everybody,” Britney said, extending out her arms to the camera.

“Letterman” airs on CBS at 11:35 PM local time.

Could Zac Efron’s Next Role Be As Publicist?


Zac Efron reportedly could be spinning gossip rather than basketballs, for his next character on the big screen.

According to E! Online’s Marc Malkin, Zac is considering playing the lead role in the big screen adaptation of “Spin,” a new novel from first-time fiction author Robert Rave. The novel is due out August 18.

While Marc reports that no deals are in place, he claims that Zac would play the central role of Taylor Green, a recent midwestern college grad who ends up working for one of the most despised publicists in New York City – the fictional Jennifer Weinstein. The young man literally stumbles into the job, by sneaking his way into one of Jen’s trendy downtown restaurant openings.

But the swag, “comes at a price, and Taylor struggles to balance his own definition of sanity with that of Jennie’s drug-fueled, high-intensity world,” according to the book’s description.

Zac is currently in production on, “The Death and Life of Charlie St. Cloud.”

Access reached out to Zac’s rep for comment, but has not yet heard back as of publishing this article.

Was Michael Jackson Planning A ‘Wonderland’ In Las Vegas?




Michael Jackson might have abandoned his Neverland Ranch in recent years, but before the singer’s sudden death on June 25, he was reportedly eyeing a property in Las Vegas that he had dubbed “Wonderland.”

According to The Las Vegas Sun, the pop star had his sights set on a 10-acre compound that he reportedly planned on moving to following his series of comeback concert dates in London.

“He got so excited, the minute we drove through the gates here he got that feeling of Neverland,” said Zar Zanganeh, a realtor with Fine Vegas Estates, told the paper. “As soon as he stepped out of the car, he said, ‘Zar, I love this place. I’m calling it Wonderland.’”

Jackson was reportedly set to offer $16.5 million for the 15,000-square-foot home, which featured secret tunnels, bulletproof doors, other doors disguised as walls and cabinets, and even a panic room.

“Safety was by far his biggest issue,” Zanganeh said. “Michael wanted to make sure that his kids were very safe.

“He was always nervous that someone could perhaps kidnap the kids, or something awful could happen, so safety was the biggest factor for him in finding a home,” he added.

The home also features a car museum big enough for 20 automobiles, a screening room for 16, stables for eight horses and a “doggie villa.”

Additionally, the Vegas home has a golf driving range, basketball and tennis courts, greenhouse, and a pool with waterfalls. There was also a 1,000-square-foot grotto guest suite, which Jackson reportedly planned on turning into a playhouse for his three children.

The home’s indoor shooting range was reportedly going to be converted into a recording studio for the singer.

Prior to announcing his plans to play 50 shows in London, many believed Jackson would make a comeback on the Las Vegas Strip. The singer reportedly recorded music – that has yet to be released – at the Studio at the Palms in 2008.

Tyra Banks To Guest-Star On ‘Gossip Girl’




Tyra Banks is heading from reality television to “Gossip Girl.”

The “America’s Next Top Model” and “The Tyra Banks Show” host will star in an episode of the third season of the popular CW drama this fall – but not as herself, a rep for the show confirmed to Access Hollywood.

Instead, Tyra will join the cast for an episode as Ursula Nyquist, a “larger-than-life actress” that Serena tangles with at a film premiere. It’ll be the supermodel’s first character television role since a 2004 episode of NBC’s “American Dreams.”

She won’t be the only fresh face on The CW show. Hilary Duff will also appear on the program as a movie star, one who enrolls at NYU and rooms with Vanessa (Jessica Szohr). “Gossip” fans will have to wait and see if their paths cross when the show returns this fall.

Marries In Beverly Hills Mark Walhberg


Mark Wahlberg is now a married man.

Wahlberg wed longtime partner Rhea Durham in Beverly Hills on Saturday afternoon, People reported.

The “Max Payne” star and his model wife have three children together, Ella Rae, 5, Michael, 3, and Brendan Joseph, 10 months.

The couple was reportedly joined by a dozen members of their friends and family at Good Shepherd Catholic Church.

According to a People source on the scene, the bride looked “like a princess and beyond stunning” during the 45-minute ceremony, wearing a white strapless dress.

The star previously revealed his plans for a summer wedding to Access Hollywood last October, noting,“We’re talking about August.”

Of his then-newborn son, he said things with Brendan and Rhea were “awesome.”

“[I’m] just happy that they’re both healthy and everybody’s home safe,” he said.
